Terms and Conditions

Welcome to PURSHO Enterprises and our SAAS solution, cafePOS. These terms and conditions govern your use of our cafe/restaurant billing and online ordering solution.

By accessing or using cafePOS, you agree to be bound by these terms and conditions. If you disagree with any part of these terms and conditions, you may not access cafePOS.

1. License to Use

1.1. PURSHO Enterprises grants you a non-exclusive, non-transferable license to use cafePOS for your internal business purposes. This license is subject to your compliance with these terms and conditions.

1.2. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of cafePOS without the express written permission of PURSHO Enterprises.

2. Account Registration

2.1. In order to access certain features of cafePOS, you may be required to register for an account. You must provide accurate and complete information during the registration process and update such information as necessary to ensure its accuracy.

2.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify PURSHO Enterprises immediately of any unauthorized use of your account or any other breach of security.

2.3. PURSHO Enterprises reserves the right to refuse registration of, or cancel an account at its discretion.

3. Billing and Payment

3.1. By using cafePOS, you agree to pay all fees and charges associated with your use of the solution in accordance with the pricing and payment terms provided to you. All fees are exclusive of any applicable taxes.

3.2. Payment for cafePOS is due upon receipt of invoice unless otherwise agreed upon in writing by PURSHO Enterprises. Failure to pay fees may result in suspension or termination of your access to cafePOS.

3.3. PURSHO Enterprises reserves the right to change the fees and pricing structure for cafePOS at any time, upon notice to you.

4. Data Security

4.1. PURSHO Enterprises takes data security seriously and implements industry-standard measures to protect your data. However, you acknowledge that no method of transmission over the internet or electronic storage is completely secure.

4.2. You agree not to attempt to breach the security of cafePOS or access data or information that you are not authorized to access. You are responsible for maintaining the security of your account credentials and for any actions taken under your account.

4.3. PURSHO Enterprises may access, preserve, and disclose your account information and content if required to do so by law or in a good faith belief that such access, preservation, or disclosure is reasonably necessary.

5. Limitation of Liability

5.1. In no event shall PURSHO Enterprises be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses arising out of or in connection with your use of cafePOS.

6. Termination

6.1. PURSHO Enterprises reserves the right to suspend or terminate your access to cafePOS at any time for any reason without notice. Upon termination, your right to use cafePOS will immediately cease.

6.2. You may terminate your account at any time by contacting PURSHO Enterprises. Upon termination, you must cease all use of cafePOS and destroy any copies of cafePOS in your possession.

6.3. Sections 3 (Billing and Payment), 4 (Data Security), 5 (Limitation of Liability), 6 (Termination), and 8 (Governing Law) shall survive termination of these terms and conditions.

7. Changes to Terms and Conditions

7.1. PURSHO Enterprises reserves the right to modify these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting to cafePOS.

7.2. Your continued use of cafePOS after any modifications to these terms and conditions will constitute your acceptance of such modifications.

8. Governing Law

8.1. These terms and conditions shall be governed by and construed in accordance with the laws of India, and you submit to the exclusive jurisdiction of the courts located in India for the resolution of any disputes.
